Our lives depend on algorithms everywhere,and algorithmic recommendations implicitly threaten freedom of expression.Freedom of expression in the algorithmic era should focus on protecting the information base.The normative sources of freedom of expression in the field of algorithmic recommendation include contractual responsibility and regulations,contractual responsibility has problems such as untruthfulness of consent,and regulations face difficulties in implementation.The third-party effect of the fundamental rights and the socialist nature of our country provides a legal basis for the intervention of the constitutional fundamental rights provisions,and the constitution should assume the role of distributing responsibility and forming a unified order.We should use the new connotation of the fundamental rights provisions to guide the establishment of the rule system,and include algorithms into constitutionality reviews.
