农村集体经济组织成员资格认定的司法逻辑与规则构建——基于广东省127份裁判文书的分析

摘要
农村集体经济组织成员资格认定规则缺乏全国性统一立法,司法裁判标准不一致,地方规则内容较空泛.梳理广东省 127 份裁判文书,分析农村集体经济组织成员资格认定的重要因素及其内在关联,认为农村集体经济组织成员资格认定应以公平正义为原则,以户籍为核心,综合考察义务履行、社会保障、村民自治等因素,在区分主要规则与辅助规则的基础上构建资格认定规则体系.
Abstract
The rules for membership recognition of rural collective economic organizations lack unified national legislation,the standards for judicial judgment are inconsistent,and the content of local rules is rather vague.After combing through the adjudicative documents of relevant cases in Guangdong province,this paper analyses the important factors for membership recognition of rural collective economic organizations and their intrinsic connection.It is believed that membership recognition of rural collective economic organizations should be based on the principle of fairness and justice,with household registration as the core,and with a comprehen-sive examination of such factors as the fulfillment of obligations,social security,and villagers'self-governance,so as to construct a rule system of membership recognition on the basis of a distinction between main rules and auxiliary rules.
