Problems inspection and regulatory approach of data circulation and utilization in cyberspace
There are several issues in data circulation and utilization,including the lack of a power and responsibility allocation mechanism,value conflicts between security and efficiency,data silos and inadequate supervision.International legislative experience offers valuable insights.The European Union safeguards personal data security through the General Data Protection Regulation(GDPR).Japan applies penalties to ensure the compliant circulation and utilization of data.And Australia strengthens data governance by improving the obligation of data breach notification.In the process of regulating data,it is essential to achieve an organic integration of the normative legal system and cyberspace codes,enabling the both to function synergistically in data governance.Based on these principles,recommendations are proposed to establish an allocation mechanism for the rights and responsibilities of data circulation,harmonize the dual values of data circulation security and efficiency,break down data silos,and maintain a policy orientation grounded in competition,thereby fostering a healthy and orderly data regulatory environment.
