国有企业自主招标机制研究

摘要
在非强制招标项目中,招标人有选择何种方式、程序的自主决策权,而自主决策权的核心表现之一就是自主招标.采用自主招标方式按照招投标形式签订合同,非应当适用《中华人民共和国招标投标法》.本文以实证方法,通过国有企业非必须招标项目的自主招标的采购实践,从打造闭环机制、特设例外制度、规范自主招标采购程序、充实专家库等方面探索并构建出行之有效的自主招标机制,大大降低企业的采购成本,深层次推动企业的高质量发展.
Abstract
In the non compulsory bidding project,the tenderer has the decision-making right to choose which way and procedure,and one of the core performances of the decision-making right is independent bidding.If a contract is signed in the form of independent bidding,the Law of the People's Republic of China on Tenders and Bids shall not apply.Based on the empirical method,this paper explores and constructs an effective independent bidding mechanism from the aspects of creating a closed-loop mechanism,ad hoc exception system,standardizing the independent bidding procurement procedure,and enriching the expert database through the procurement practice of independent bidding for non necessary bidding projects of state-owned enterprises,so as to greatly reduce the procurement cost of enterprises and promote the high-quality development of enterprises.
