China's algorithmic expansion in practice tends to deviate from the rule of law track.Algorithms,the"su-per power"of the intelligent society hasn't been"tamed"in the practice of the rule of law,and the fundamental reason for this paradoxical phenomenon is the inherent conflict between algorithms and law.On the one hand,people expect the law to transform algorithms from something strange and potentially dangerous to something that can be integrated into modem civili-zation and daily life.On the other hand,the established rule of law system fails to meet this expectation.The deeper pene-tration and innovative breakthroughs of algorithms in the intelligent society have further intensified the tension between algo-rithms and the law,which may lead to more legal risks and theoretical difficulties.The legal governance of algorithms can't be discussed and studied on the basis of separating algorithms from the rule of law,but must be guided by descriptive the-ories and return to the proposition of the relationship between algorithms and law.Within the general logic of algorithmic ex-pansion and the basic framework of the rule of law,the algorithm and the law will be unified under the governance theory,and then based on the organic embedding of algorithmic and legal governance innovation,to promote the healthy,orderly and flourishing development of algorithms on the track of law,so that the ultimate purpose of algorithmic governance to serve a better future for human society can be truly realized.
