Violating the will of others is the key expression of the essential characteristics of the crime of infringing sex-ual decision-making right.Sexual tension of the perpetrator increases, and sexual violence is carried out uncontrollably, forcing the victim to be placed in the state of a third mechanism. The transition between projection and withdrawal in ex-treme survival states leads to the victim's body in a state of rigidity and stiffness, presenting a tense and motionless state. The victim's body has been passively prepared from a physiological perspective to accept the risk of sexual assault that can-not be avoided, rather than agreeing to accept the risky sexual assault behavior.Half-declining is the body language used by the perpetrator to indicate that their means or purpose have violated the will of others, indicating the victim's complete refusal intention;Forced rationality belongs to irrationality,half-accepting proximity constitutes tense immobility, and forced rational consent also does not allow the perpetrator to harm the corresponding legal interests. It is not a complete ex-pression of the victim's consent and does not constitute the victim's commitment, that is,the act of refusing infringement. In the dimension of sexual intention,it should be emphasized that consent is ignored, and there is no positive consent from the victim in both half-declining and half-acceptance.China should adopt two methods, positive recognition and negative negation,to determine whether there is positive consent.
