Highlights and Innovations of the Judicial Interpretation of Contracts
Using the scientific method of legal interpretation and loophole filling,the Interpretation of the Contracts Part refines the general part of the Contracts Part of the Civil Code and the contract rules that are systemati-cally related to it,fills the legalloopholes in the Civil Code,and further develops and improves the relevant rules of the Contracts Part of the Civil Code.The interpretation focuses on the connection between the con-tract part and other parts of the Civil Code,as well as the connection between substantive law and procedural law.In the formulation of the judicial interpretation,it focuses on the refinement and sublimation of local ex-perience,and pays attention to the experience of comparative law,empirical analysis,in line with the legal theory and public sentiment,thus presenting many highlights,highlighting the local,practical and contempo-rary nature.The interpretation greatly contributed to the improvement of the contract law,to promote sustain-able,healthy and high-quality economic and social development to provide legal protection and help.Howev-er,from the perspective of the system structure,there are still flaws in the integration of the system and other aspects.
