On the relationship between the implementation of Constitution and the implementation of Law in the Chinese Context
It has always been regarded as an important way to implement the Constitution by concretizing the spirit,principles and provisions of the Constitution through laws.The implementation of the constitution and the implementation of the law are both im-plementation activities that carry out the normative requirements into the specific social life.They seem similar on the surface,but because of the special nature,function and value aim of the Constitution,the implementation of the constitution and the imple-mentation of the law cannot be equated.The deficiency of the prerequisite of implementation of the law and the structural defects of implementation of the law make it difficult for guaranteeing the quality and effect of implementation of Constitution alone.More-over,the implementation of the Constitution depends on a variety of implementation methods and paths,in addition to implemen-tation of the law,the Constitution also relies on direct implementation and political implementation to ensure the comprehensive-ness and effect.However,in the Chinese context,it is still important to promote the implementation of the Constitution through the implementation of the law,which should be guided by the value,principle and spirit of the Constitution,and take the protec-tion of basic rights as the highest value aim.In improving the system for ensuring full compliance with the Constitution,the imple-mentation of the law should play more crucial role in the implementation path of the rule of law.
