Promotional Legislation as Implementation of the Constitution
Enacting promotional legislation in accordance with the Constitution is an essential method to implement China's Consti-tution.The programmatic features of the Constitution reserve sufficient space for promotional legislation.When the National People's Congress adopts promotional legislation to implement the national policies established by the Constitution,those promo-tional legislative initiatives that are supported by national policy provisions,respond to the fundamental rights of citizens,and solve market failures are more likely to be included in the legislative agenda.The hierarchical govemance tool system stipulated in China's Constitution also provides a substantial constitutional toolbox for promotional legislation.Promotional legislation demon-strates a more active concept of constitutional implementation,from constitutional control to constitutional formation,from confir-mation of the status quo to advancement of the future,from confirmation of rights to empowerment,from management-oriented government to service-oriented govemment,from post-regulation to pre-guidance,from single govemance to pluralistic co-gov-emance.Looking forward to the follow-up legislation trend,we should strengthen promotional legislation in terms of political civi-lization,spiritual civilization and social civilization,embed the promotional concept into various departmental laws,and combine it with the transformation of government functions.
