Organizational Evolution and Governance Transformation of Organized Cybercrime
In the current cyberspace,the trend of"organization"of organized crime is increasingly enhanced with the support of network technology,and its organizational structure,criminal participation forms and organizational control modes have changed,which has enhanced the concealability,spread and harmfulness of criminal behavior,resulting in a greater governance dilemma for organized crime in cyberspace.The existing criminal law evaluation model should go further on the basis of the node theory,advocate the organic theory that fits the current characteristics of organized crime,evaluate cybercriminal organizations as criminal organisms with mature functions,establish a multi-center criminal participation evaluation mechanism according to the evolution direction of criminal organizations,and formulate a prioritized classification and governance plan.At the governance mechanism level,we should adhere to the"combination of skills"and phased governance,focus on governance of irreplaceable core nodes,and gradually extend the scope of governance to the upper and downstream auxiliary nodes,and gradually achieve full chain gov-ernance.At the level of crime punishment method,we should change the focus of governance from peripheral crime to core crime,and realize penetrating crime punishment to specific nodes.
