Analysis on the Path of Misdemeanor from the Perspective of Execution Connection
The proportion of misdemeanors in the criminal structure is too high,resulting in a sharp increase in the number of people involved in crimes.In order to effectively control the crime circle,reduce the application of misdemeanor punishment and reduce the negative effects of punishment,we should realize the criminalization of some misdemeanors.On the premise that the legislation has not been amended,to realize the criminalization of misdemeanors through judicial channels,we should pay atten-tion to the alternative measures of punishment,strengthen the connection of execution,and substitute administrative punishment for criminal punishment.To this end,we need to update the criminal justice concept,pay more attention to the application of the criminal justice policy of"less arrest,more prosecution and more custody",give procuratorial organs greater discretion,expand the scope of application of relative non-prosecution,strengthen the improvement of supporting mechanisms and systems,realize the efficiency and transparency of administrative punishment,and optimize the misdemeanor governance model.
