论我国城市体检制度的完善——以环境保护法为依据

城市体检作为"城市病"治理的重要实践与制度安排,旨在发现和解决城市发展中的问题.然而,当前学界、实务界及政府部门对城市体检的认知尚存在分歧,亟需统一认识.我国在城市体检实践方面已初步构建相关制度框架,但仍存在与城市规划实施评估界限不清、对"城市病"涵盖范围过于狭窄等不足.为充分发挥城市体检在"城市病"治理中的作用,应回归其初衷,避免仅作为城市规划实施评估的辅助角色,应重点关注"城市病"的环境损害部分,并以环境保护法为基础,构建独立且以"城市病"治理为核心功能的法律制度.同时,应加强相关法律的制定与实施,确保城市体检工作在法治轨道上开展,为城市可持续发展提供有力保障.
On the Improvement of Urban Physical Examination System in China——Based on Environmental Protection Law
Urban physical examination is an important practice and institutional arrangement for the governance of"urban disea-ses".It aims to discover and solve problems in urban development.However,there are still differences in the cognition of urban physical examination among the academic,practical and management circles,which urgently need to be unified.In China,the relevant institutional framework has been initially established in the practice of urban physical examination,but there are still some shortcomings,such as unclear boundaries with urban planning implementation evaluation,and too narrow coverage of"ur-ban diseases".In order to give full play to the role of city physical examination in the governance of"urban diseases",we must return to its original intention and avoid being only an auxiliary role of urban planning implementation evaluation.China should fo-cus on the environmental damage part of"urban diseases"and build independent legal systems based on environmental protection laws with"urban diseases"governance as the core function.At the same time,we should strengthen the formulation and imple-mentation of relevant laws to ensure that urban physical examination work is carried out on the track of the rule of law,providing strong guarantees for the sustainable development of cities.
