"Chinese path to modernization of rule of law"is the core category of unifying the practice and theory of rule of law in China,and will become the cornerstone of building China's independent legal knowledge system.The"Chinese"path to moderni-zation of rule of law is firstly and foremost the modernization of rule of law in China.In the descriptive sense,it means that this new road to modernization of rule of law"originated in China",that is,it is rooted in Chinese history and culture,and is based on Chinese social practice.It also provides a Chinese plan for the modernization of rule of law,thus demonstrating China's subjec-tivity.However,the"Chinese path"to modernization of rule of law has a certain universality in terms of its content propositions,fundamental basis,and value pursuits.It is also necessary to provide a modernization model of rule of law with general referential significance for the development of rule of law in all the world,thus to provide a"universal paradigm in pluralism".Rule of law is a modern enterprise,and modernization is a diachronic process.Therefore,the modernization of rule of law is a historically never-ending process of continuous self-renewal and iteration.The modernization of legal system is only a necessary rather than sufficient dimension of the modernization of rule of law.As a result,"Chinese path to modernization of rule of law"constitutes a core category in the theory of rule of law in socialism with Chinese characteristics that combines both aspects of objective descrip-tion and value justification.
