反垄断法视野下社区 团购中的优势传导效应

优势传导是大型平台利用自身优势扩张的方式之一.大型平台扩张除了涉及数字平台中的传统竞争模式,还涉及实体经济的新型竞争结构.目前对于市场新行为的反垄断规制尚停留在传统的反垄断分析方法,应根据行业特性来梳理对应的方法论,才能更好地应对平台无序扩张带来的影响.社区团购作为典型的线上—线下协同经营的模式,对于反垄断的规制有一定的挑战.创新与有效竞争促进平台经济的发展,应通过动态评估的方式来确定创新行为与反垄断之间的边界,利用优势传导效力对平台企业进行分级管理,有利于建立良好的市场经营模式.
Leverage effect of Community Group Buying under the Antitrust Law Framework
Advantage transmission is one of the methods for large platforms to take advantage on expanding.In addition to the tra-ditional competition model in the digital platform,the expansion of large-scale platforms also involves the new competitive struc-ture of the real economy.At present,the anti-monopoly regulation of new market behaviors is still stuck in the traditional anti-monopoly analysis method,and the corresponding methodology should be sorted out according to the characteristics of the industry to cope with the impact of disorderly expansion of the platform effectively.As a typical online-offline collaborative operation mod-el,community group-buying poses certain challenges to anti-monopoly regulations.To promote the development of the platform economy through innovation and effective competition,the boundary between innovative behavior and anti-monopoly should be determined through dynamic evaluation,and a good market management model should be established for platform enterprises to use their advantages to transmit effectiveness and hierarchical management.
