On the System of Compliance Inspection Term for Enterprises Involved in Cases
The system of compliance inspection term is an important part of the compliance system of enterprises involved in crimi-nal cases.In the current pilot practice of compliance reform for enterprises involved in criminal cases,the system of compliance inspection term encounters problems such as non-uniformity of the subjects that set the term,limited scope of the length of term,irregularity of the legal instrument,and imperfection of the applicable rules.The reasons for the aforementioned problems are re-lated to the factors such as the nature of the subjects that set the term,the compliance inspection term being subject to the time limit of criminal procedure in the review and prosecution stage,and the lack of clarity of the existing norms.In the process of im-proving the legal norms in the future,it is necessary to rely on the system of conditional non-prosecution in corporate compli-ance,stipulate that the procuratorial organs shall be the subject who set the term of compliance inspection,divide the scope of the term of compliance inspection according to the case situation,refine the commencement,expiration and extension rules of the compliance inspection term,and make clear the relationship between the compliance inspection term and the statute of limita-tions,so as to further promote the optimisation and development of the system of compliance inspection term,and achieve the val-ue and goal of compliance reform for enterprises involved in criminal cases.
