Inheriting and Breaking through the Traditional Legal Methodology of Environmental Law under the Overall Ecological View
The methodology of jurisprudence is based on the"value-principle"internal system and the"legal sources-legal inter-pretation"external system.The traditional legal methodology which focuses on the protection of individual interests cannot be ap-plied to environmental law,and causes many controversies.The Overall Ecological View takes"Harmonious Coexistence between Human and Nature"as its basic value.Through the decomposition into three layers,this paper explained environmental legal methodology in its internal system and external system,and then constructed the new environmental legal methodology under the Overall Ecological View.
