The Modernization of Chinese Judicial Democracy in the Age of Digital Intelligence and Its Future Orientation
The modernization of judicial democracy relying on digital technology reflects"China's practice"and"China's contri-bution",but at the same time,there are also potential risks,which need to be scientifically responded to,so as to realize the in-depth promotion of judicial democracy modernization.In the age of digital intelligence,the modernization of Chinese-style judi-cial democracy presents the practical trend of domain virtualization,process digitization and subject networking,and has theoreti-cal contributions to promoting judicial justice from close to justice to visible justice,from result public trust to process public trust,and from central supervision to distributed supervision.However,judicial democracy under the digital attribute may also have potential risks such as inducing group polarization,restructuring process black box and causing subject manipulation.To this end,it is necessary to resolve the polarization of judicial democracy through the construction of the coupling of virtual and real space,and to realize the re-transparency of the digital democratic process by strengthening the interpretation power of technology and algorithm.The effective prevention of the intervention of participants in judicial democracy by technology can be achieved through the vagueness of data marks,the institutionalization of technical supervision and the full implementation of the practice of people's democracy in the judicial scene.
