The Systematic Perfection of the Personal Information Reasonable Use System
The"Civil Code"and the"Personal Information Protection Law"systematically stipulate the personal information rea-sonable use system through a systematic arrangement from general principles to specific provisions,providing a systematic frame-work for information processors to reasonably utilize personal information.However,there are still challenges in stability,accurate application,and the coordination of public and private interests.To fully leverage the institutional dividends of reasonable use of personal information,China should make systematic improvements to the rules of reasonable use of personal information based on the provisions of the"Civil Code"and the"Personal Information Protection Law".Firstly,further strengthen the rationality of the"reasonable"determination in the reasonable use of personal information,clarify the specific connotation of reasonable use sce-narios,and expand and coordinate the types of reasonable use scenarios.Secondly,focus on the coordinated follow-up of the per-sonal information reasonable use security system,strengthen the regulatory intervention of the safety of reasonable use of personal information,the proportional allocation of rights and obligations,and the coordination mechanism between security administrative supervision and judicial remedies,to promote the incentive compatibility of personal information rights and interests with econom-ic and social development.
