Comparative Study on the Liability Rules for Traffic Accidents of Autonomous Vehicles in Local Regulations
Local legislation stipulates the rules of responsibility for traffic accidents involving self-driving cars,which is an attempt before the uniform national legislation.Although most lo-cal legislations only provide general rules on the liability for traffic accidents involving self-driv-ing cars,some local legislations provide specific rules on the liability under the same circum-stances,which provide reference for future national legislations,as well as research objects for the rules and theories on the liability for traffic accidents involving self-driving cars.In prac-tice,it is practical to categorize autopilot systems on the basis of whether they are functionally in-active or activated and stipulate that the liability for traffic accidents of self-driving cars applies to the responsibility of the person and the responsibility of the car respectively.As far as specific rules are concerned,the"human responsibility"for traffic accidents involving self-driving cars can be applied to the traditional motor vehicle traffic accident liability rules and the"vehicle re-sponsibility"can be applied to the product liability rules in principle,but they must be supple-mented and improved to form a systematic self-driving car traffic accident product defect liability rules.However,it should be supplemented and improved to form a systematic liability rules for traffic accidents involving self-driving car.
