Research on the Application Path of Big Data in Prosecutorial Case Guidance System
The procuratorate guiding cases are designed to guarantee the unified and correct implementation of the law.They possess both supervisory attributes and procedural characteristics and have a symbiotic relationship with big data in the contemporary era.On one hand,big data monitoring promotes the formation of similar cases;the classification map ensures the typicality of similar cases;and the algorithmic rationality enhances the objectivity of applying similar cases.On the other hand,fragmented and redundant big data information,along with the big data corre-lation analysis technology,are highly likely to undermine the authority,accuracy,and causality of guiding cases,as well as the reasoning of case law.To ensure the intellectualization of legal practice and the legalization of intelligent technologies and to enhance the implementation effect of the procuratorate case guidance system,it is necessary to optimize the big data application path of the procuratorate case guidance system by standardizing the digital expression of case texts,im-proving the digital collaborative public disclosure mechanism,and insisting on guiding big data technologies through legal methods.
