With the rise of the scientific and technological hotspot of artificial intelligence,the cross-research of artificial intelligence and law has gradually increased,and the debate on the status of the legal subject of artificial intelligence is one of the hot topics.However,due to the lack of accurate understanding of artificial intelligence and the neglect of the standardization and reality of legal research,there are two defects in the existing debate:first,the discussion domain lacks substantive meaning;Second,the research path violates the logic law.By reflecting on the dispute over the legal subject status of artificial intelligence,it can not only help avoid falling into the false academic prosperity of studying false problems,but also remind the research of artificial intelligence law must be built on the basis of in-depth understanding and rational analysis of artificial intelligence,and find the true problems of law in common sense and essence.The legal technical problems and the legal subject status of artificial intelligence,which do not need to substantially change the application of established laws,are the pseudo-problems of jurisprudence.The new phenomena brought by artificial intelligence make the existing laws unable to adjust the application of new behaviors and the meta-problems of law are the real problems of jurisprudence.
