The Dual Impact of"Re-expansion"of Local Legislative Power on Community Governance and Practical Optimization
The Legislation Law amended and implemented in 2023 includes"community governance"into the scope of statutory matters of local legislative power,which is in essence a positive"re-expansion"for local legislative power.Based on the realistic background of this"re-expansion",it is necessary to explore the dual impact on the community governance itself.On the one hand,the positive significance is reflected in that the informal experience of community governance can be transformed into a formal system,and provided with sufficient safeguards under the rule of law,so as to improve the institutionalization and rationalization level of community governance at the present stage.On the other hand,the negative effect is that legislators incorporate community governance into local legislation,which may make the practice of community governance,which originally emphasized convenience and flexibility,fall into a passive and rigid reality dilemma.Accordingly,in promoting the optimization of community governance practices in the context of the"re-expansion"of local legislative power,emphasis should be placed on the positive radiation of the rule of law principle,the promotion of the integration and interaction of formal and informal systems,and the active expansion of public participation in order to enhance social acceptability.
