Evidence Collection and Identification in Seed Variety Infringement Litigation
With the rapid development of modern biotechnology,the protection of intellectual property rights for seed varieties has become an important issue in the field of agricultural science and technology.This study uses the infringement lawsuit between Jinyuan Seed Industry and Hengji Limagrain as a case study to explore the problems of evidence collection and identification in seed variety infringement litigation.By analyzing the focal points of the dispute and the methods of evidence provision and identification presented by both parties,this study reveals the inadequacies and challenges of current laws in handling such technology-intensive cases.Furthermore,it discusses the necessity of improving the standardization of identification techniques,perfecting the legal framework for seed variety protection,and strengthening the awareness of seed research and development and protection.These measures are pointed out as being crucial for the healthy development of the seed industry.This research provides empirical support and strategic guidance for the protection of intellectual property rights of seed varieties,aiming to offer reference and insights for related legal practices and technological applications.
