Legal Approaches to Human Rights Protection for Individuals with Mental Disorders:Theoretical Mechanisms and Directions for Construction
The current social climate and judicial practices indicate that the human rights of individuals with mental disorders have not received the attention they deserve.In China,three primary challenges hinder the protection of the human rights of persons with mental disabilities:inadequate mental health legislation,insufficient standards for involuntary hospitalization,and pervasive social discrimination.To address these issues,it is essential to strengthen the foundational principles and concepts surrounding the protection of human rights for individuals with mental disabilities.This includes establishing specific rules and requirements,reforming involuntary hospitalization standards through the practical application of the principle of legal reservation,and adopting a multi-faceted approach to combat prejudice and discrimination against individuals with mental disabilities.Such efforts aim to ensure comprehensive protection of their human rights and to advance the legal safeguarding of vulnerable groups in our country.
