Content and Impact of Pan-securitization of the US Intellectual Property Rights Regime and China's Countermeasures

摘要
近年来,属于私权的知识产权逐步成为美国对外经济政策的工具.美国将技术、投资和知识产权叠加,广泛地将知识产权与国家安全相联系,运用政策组合工具强化美国知识产权保护,以实现对他国的技术封锁.美国知识产权机制泛安全化现象凸显,不仅涵盖国防技术,而且涉及两用技术、前沿技术等领域.美国以保护本国核心技术知识产权为目标,通过强化商业秘密保护、实行域外管辖、泛化管制标准、瞄准前沿技术、进行刑事制裁及法律法规联动封锁等方式,构建了完整的知识产权安全机制.美国此举将阻碍中国企业的海外投资、产业升级、技术获取等行为,使中国企业在"走出去"过程中面临更多的知识产权安全风险.对此,既要针对美国法律法规进行应对,又要完善中国的反制法律体系,构建海外知识产权安全预警机制,从国内国际两方面维护中国知识产权安全.
Abstract
Intellectual property rights,which are private rights,have gradually become a tool of US foreign economic policy in recent years.The United States combines technology,investment and intellectual property rights,widely linking intellectual property rights with national security,and uses a combination of policy tools to strengthen the protection of US intellectual property rights in order to achieve technological blockade against specific countries.The pan-securitization of intellectual property rights regime has become prominent;it not only covers defense technology,but also involves dual-use technology and front-line technology,among others.With the goal of protecting the intellectual property rights of its own core technologies,the United States has formed a complete security regime of intellectual property rights through strengthening protection of trade secrets,implementing extraterritorial jurisdiction,generalizing regulatory standards,targeting front-line technologies,imposing criminal sanctions,and jointly blocking through related laws and regulations.The US stance will hinder Chinese enterprises'overseas investment,industrial upgrading and technology acquisition,and make them face more security risks of intellectual property rights in the process of"going global".In this regard,this article proposes that China should not only tackle the challenges from US laws and regulations but also improve its capacity to hit back,build an overseas early warning mechanism for intellectual property rights security and safeguard its intellectual property rights security from both international and domestic perspectives.
