Research on the Standard Contract for the Outbound Transfer of Personal Information in China under the Global Data Regulatory Competition
Produced in the era of increased regulatory competition for cross-border data flows,the standard contract for the outbound transfer of personal information is an important data cross-border regulatory tool,and it provides an interoperable cross-border data flow model for the international community.By sorting out the histori-cal evolution and analyzing the current status of the system,we can find that the standard contract for the outbound transfer of personal information in China adheres to the value orientation of data free flow based on data security,and it is an innovative data supervision tool combining administrative and enterprise.It aims to protect the interest of third-party and supervise the whole process of data outbound,and it uses contractual rights and obligations to immobilize data supervision standards.As an important means for China to join the global data regulatory competi-tion,the standard contract system for the outbound transfer of personal information has experienced a development process from scratch under the trend of the times,and all aspects of details are gradually being improved.Howev-er,there are still problems in normative structure,clause norms and continuous supervision.China should draw on legislative focus,structure reconstruction and regulatory content to strengthen its institutional foundation,so as to promote China's participation in global data competition.
