公共图书馆在建设数字资源过程中,会因数据库商未获部分作品授权而被诉侵害作品信息网络传播权,但公共图书馆被判是否承担责任的结果不同,其主要原因是不同侵权种类下的归责原则及法院认定共同提供作品行为的标准不同.被认定为提供作品行为的案件适用无过错原则,公共图书馆被判承担损害赔偿责任;被认定为网络服务提供行为的案件适用过错原则,没有过错的公共图书馆不需承担责任.而法院在不同案件中分别采用了服务器标准、定向链接标准、不可或缺标准及共建标准认定共同提供作品行为.公共图书馆数字资源建设不仅应尽合理注意义务防止过错产生,还应针对法院的裁判标准严谨化技术操作,避免被认定为作品提供行为.表3.参考文献16.
Abstract
In cases where libraries are sued for infringement on information network transmission rights of works due to unauthorized works from database suppliers in the process of constructing digital resources,the conse-quences of whether public libraries being held responsible for similar cases are different.The main reason is that the principles of imputation and the standards for identifying joint provision of works recognized by the court va-ry according to the type of infringement.In cases where joint provision of works is recognized,the principle of non-fault is applied,and the public library is held responsible for compensation for losses.In cases where net-work service provider behavior is recognized,the principle of fault is applied,and faultless public libraries are not held responsible.Courts uses different standards,including server standards,directional link standards,in-dispensable standards,and co-construction standards,to identify joint provision of works in different cases.Pub-lic libraries should not only fulfill their obligations to prevent faults during the construction of digital resources,but also strictly operationalize their technology to avoid being recognized as providers of works in accordance with the court's judgment standards.3 tabs.16 refs.
