On the Fourfold Transcendence of the Modern Rule of Law of the Chinese Nation
The modern rule of law in China is a new form of human rule of law opened up by the Chinese modernization of the rule of law,and it is a concrete manifestation and special expression of the modern civilization of the Chinese nation in the field of the rule of law.Looking back at the five-thousand-year history of civilization of the Chinese nation,it is clear that the comprehensive practice of governing the country according to law in the new era has solved the difficult problems in the rule of law,such as the relationship between the traditional and modern,Chinese and Western,theoretical and practical,institutional and human,opening up a new path of Chinese modernization of the rule of law and expanding a new realm of Chinese rule of law.The generative logic of the modern rule of law of the Chinese nation can be summarized as"fourfold transcendence",namely,the transcendence of inheritance from"tradition"to"modern",the inclusive transcendence from"other"back to"autonomy",the creative transcendence from"hypothesis"to"practice",and the aesthetic transcendence from"the highest good"to"the highest beauty".
