The development of new uses for drugs is generally accompanied by the discovery of new therapeutic mechanisms.This article summarizes and generalizes some rules and core issues when seeking intellectual property protection with actual cases,especially the practical process of transforming new technologies into drug patents.As a carrier of intellectual property protection,whether the scope of patent rights is clear and supported by the patent description is crucial for successful patent protection.The article discusses and summarizes the impact of new therapeutic mechanisms for drugs on the scope of patent rights.Based on actual cases,it is concluded that,further research should be conducted on the drug's therapeutic effects on diseases after discovering a new mechanism,and the results of such efficacy should be documented in the patent application to better secure intellectual property protection.
