摘要

几年来,国家愈发将老字号知识产权保护提升到国家战略层面.中共中央、国务院印发的《知识产权强国建设纲要(2021-2035年)》中提出,加强驰名商标保护,发展传承好传统品牌和老字号[1].北京、广州、江苏等地也纷纷出台政策措施,加强老字号知识产权保护.然而,在新技术、新业态的冲击之下,知识产权侵权行为呈现复杂化、隐蔽化等特点,老字号企业在知识产权维权道路上步履维艰,也阻碍了老字号企业的良性发展.因此,仅靠单一主体难以解决老字号企业在知识产权保护方面面临的现实难题,唯有引入司法、行政、协会等多元主体协同保护机制,形成治理合力才是实现老字号知识产权保护的有效路径.

Abstract

In recent years,the country has increasingly elevated the protection of intellectual property rights of time-honored brands to the national strategic level.The Outline for Building a Strong Intellectual Property Country(2021-2035)issued by the Central Committee of the Communist Party of China and the State Council proposes to strengthen the protection of well-known trademarks,develop and inherit traditional brands and time-honored brands.Beijing,Guangzhou,Jiangsu and other places have also introduced policy measures to strengthen the protection of intellectual property rights of time-honored brands.However,under the impact of new technologies and formats,intellectual property infringement has become more complex and covert,making it difficult for time-honored enterprises to protect their intellectual property rights and hindering their healthy development.Therefore,relying solely on a single entity is difficult to solve the practical difficulties faced by time-honored enterprises in intellectual property protection.Only by introducing a multi-party collaborative protection mechanism such as the judiciary,administration,and associations,and forming a joint governance force,can we achieve an effective path to protect the intellectual property rights of time-honored enterprises.
