摘要
加快推进自由贸易试验区建设是我国顺应国际经贸发展新趋势,实行更加积极主动的开放战略的重要举措.建设贸易强国和知识产权强国要求构建和完善对外贸易知识产权保护调查机制和自由贸易试验区知识产权保护专门机制,不断强化知识产权海关保护.当前,我国海关知识产权执法实践中存在法律规范有待完善、海关执法与相关部门协调联动不足、侵权认定存在困难、侵权纠纷多且难以彻底解决等诸多问题.研究提出可从完善相关法律法规,加强与地方市场监管、知识产权等部门的执法协作,寻求知识产权侵权判定的专业支撑以及促进侵权纠纷多元化解等方面入手不断完善海关知识产权保护机制.
Abstract
Accelerating the construction of free trade zones is an important measure for China to comply with the new trend of international economic and trade development and to implement a more proactive opening-up strategy.The construction of a strong trading country and a strong intellectual property rights country requires the construction and improvement of an investigation mechanism for the protection of intellectual property rights in foreign trade and a specialized mechanism for the protection of intellectual property rights in free trade zones,as well as the continuous strengthening of customs protection of intellectual property rights.At present,there are many problems in China's customs enforcement practice of intellectual property rights,such as legal norms need to be improved,insufficient coordination and linkage between customs enforcement and relevant departments,difficulties in the identification of infringement,and many infringement disputes that are difficult to be resolved thoroughly.The study proposes that the Customs IPR protection mechanism can be refined by improving relevant laws and regulations,strengthening the law enforcement collaboration with local market supervision and IPR departments,seeking professional support for IPR infringement determination,and promoting diversified settlement of infringement disputes.
