Practices and Challenges of Out-of-court Administrative Dispute Resolution in China
Large amounts of social disputes emerge in times of economic transition period in China,with many involving governmental agencies.Formal lawsuits could not meet the demand of resolving the disputes; therefore it is imperative to establish dispute resolution mechanism out of court proceedings but on the law-of-rule basis.ADR (Alternative Dispute Resolution),as an out-of-court dispute resolution approach,has strong reference signifi cance in improving social governance and effectively resolving a variety of disputes.This paper takes a farm house dismantling dispute occurred in Jiangsu Province as a case.Focusing on the administrative disputes resolution with government as a client and by reviewing functions and practices of the ADR in foreign countries,this research examines the challenges that China is confronting in terms of improving the out-of-court dispute resolution.
