摘要
为提升甘肃省非正常专利申请治理的目的性、高效性与可行性,文章以国家知识产权局2022年累计通报的4批甘肃省非正常专利申请数据为例,通过数据分析方法,厘清了非正常申请专利行为种类,从非正常申请专利类型、非正常申请专利行为表现的地区分布、申请方式、职务/非职务、申请主体等维度,全面分析了甘肃省非正常申请专利行为的客观特征及内在原因,并从完善法律、完善审查模式、细化治理政策、营造良好专利代理市场氛围等方面提出相应对策,以期抑制非正常申请专利行为.
Abstract
In order to improve the purpose,efficiency and feasibility of abnormal patent application manage-ment in Gansu Province,This paper takes the four batches of abnormal patent application data in Gansu Province no-tified by the State Intellectual Property Office in 2022 as examples,and clarifies the types of abnormal patent appli-cations behaviors through data analysis.The article comprehensively analyzes the objective characteristics and inher-ent reasons of abnormal patent application behaviors in Gansu Province from the perspectives of abnormal patent types,regional distribution of abnormal patent application behaviors,application methods,position-related/non-po-sition-related,and applicants.It also proposes corresponding countermeasures to restrain abnormal patent applica-tion behaviors from the aspects of improving laws,improving the review model,refining governance policies,and creating a good patent agency market atmosphere.
