Research on the Prevention of Mortgage Financing Litigation Dispute of Land Management Right——Normative Analysis Based on Judgment Documents
With the deepening of the reform of mortgage system of rural land management rights in China,mortgage financing of land management rights has become an important way to solve the financing constraints of farmers and new business entities.Through the analysis of 1133 refereeing documents in China's refereeing documents network,this kind of litigation has some superficial features,such as concentrated sources of cases,too single types of collater-al,and disputes in contract provisions.Then,it is found out that the real causes of land management right mortgage disputes in practice are imperfect transaction circulation market,imperfect rural credit system,imperfect land evalua-tion mechanism,imperfect social security system and other factors.In view of the land management right mortgage disputes,we should promote the improvement of the land management right mortgage financing business and reduce the mortgage litigation by constructing the land circulation trading market,establishing the credit loan mechanism,perfecting the land management right value evaluation system and improving the rural social security system.
