Digital Supervision of Non-custodial Measures in the Context of"Less Arrest,Prudent Prosecution and Cautious Detention"
While the judicial policy of"less arrest,prudent prosecution and cautious detention"has been implemen-ted and promoted,the digital supervision mode of non-detention measures based on digital technology has emerged.The digital supervision of non-detention measures in China has produced a series of means such as electronic hand-cuffs,electronic shackles,and"non-detention code",but there are also problems such as lack of operational norms,algorithm black box effect,and infringement of personal privacy.Therefore,we can find a perfect path at the two levels of system and practice:on the system level,we should clarify the legal nature and applicable norms of the digital supervision of non-detention measures;on the practice level,we need to establish a digital operation platform for non-detention measures,build a Buffer behavior warning mechanism,and strengthen the efficiency of pro-curatorial supervision.
