The Theoretical Path of Legislation on the Nature Reserve System
The report of the 20th National Congress of the Communist Party of China(CPC)proposed to"develop the national park-based nature reserve system".To comprehensively promote the rule of law in all the aspects of work,it is imperative to accelerate the legislative process for the establishment of the nature reserve system.In this process,it is necessary to base actions on the scientific understanding of the"nature reserve system",aim to develop the"nature reserve management system",and achieve the"systematization of nature reserve legislation".Since this is a natural geographical space distinct from administrative regions,the legislation on nature reserves should be positioned as special area law within the ecological and environmental protection legal system.Legislation on the nature reserve system,taking this special space of natural ecosystem as the objects of protection,aims to shape multi-dimensional legal relationships,establish legal institutions and form a complete and coordinated legal system that centers on the nature reserve law,with specialized legislation of various types of nature reserves such as the national park as important components.Given the practical legislative path of formulating the national park law in advance,the framework of the law should be designed with a systematic approach to nature reserve legislation,and relevant systems should be reasonably arranged.
