Data Trading Platform Governance:The EU's Approach and Its Implications
Due to their first-mover advantages and a strong orientation towards rights protection,the EU's data governance and trading platform governance are at the forefront of the world and hold referential value.The EU's frameworks for the governance of data trading platforms originate from the fundamental requirements of data treating,have grown and developed due to the general protection of data rights,and are improved by the specialized legislation of the digital market.The content of the systems centers around the data protection rules of GDPR,takes the regulation and supervision of trading platforms as the starting point,and aims at the standardization and protection of data utilization.In light of the current development trends and governance needs of data trading platforms,China could consider adopting a"total-component"legislative model inspired by the EU's approach.This model would guide the development of data trading platform governance system through overarching legislation,respond to governance problems with principled systems in a timely manner,and then build a regulatory scheme covering the whole process of"subject-platform-user".
