Study and Improvement of the Supervision and Inspection in Conditional Non-prosecution System Against Juvenile Offenders
Adhering to"education,persuasion and rehabilitation",the conditional non-prosecution(CNP)system provides a new approach to pretrial diversion and non-criminalization of juvenile offenders in China.Supervision and inspection are important parts in the education and rehabilitation for juvenile offenders,but many difficulties are obviously seen in practice,including the shortage of full-time subjects fulfilling supervision and inspection duties,the lack of scientific and targeted attached conditions,insufficient supports from the state and the imperfect social support system.The supervision and inspection in conditional non-prosecution refer to the process based on multiple social subjects'participation and interaction,and giving full play to the due functions of attached conditions will directly affect the actual effect of supervision and inspection.Therefore,we should explore the content of supervision and inspection in practice,straighten out different subjects'responsibilities in supervision and inspection to ensure their fulfillment of full-time duties,formulate more professional and targeted attached conditions,and establish and improve the social support system under the state's support,thereby achieving the core purpose of supervision and inspection and smoothly getting juvenile offenders reintegrated into society.
