论少数民族习惯法的规范化困境及其应对

摘要
少数民族习惯法是民族文化的一部分,与民族地区的法治建设关系紧密.有效发挥民族习惯法的作用,离不开对民族习惯法的规范化.在民族法治、良法善治、文化更新等要求下,民族习惯法的规范化势在必行.少数民族习惯法面临的人治文化束缚、法治文化欠缺、相对独立性与价值问题,阻碍少数民族习惯法的规范化.以民族自治、合法化、价值与思维规范为路径,能有效应对少数民族习惯法的规范化困境.
Abstract
Minority customary law is a part of an ethnic minority's culture and has a strong bond with the rule of law construction in ethnic regions.Effectively exerting the role of a minority customary law can't do without its standardization.Under the requirements of the rule of law in work related to ethnic minorities,good law and governance,as well as the cultural renewal,the standardization of minority customary law is imperative.However,there are many factors hindering the standardization of minority customary law,such as the restriction caused by culture of rule by men,the lack of rule of law culture,as well as the relative independence and value issues.In order to effectively crack the dilemmas in the standardization of minority customary law,the approaches such as national autonomy,legalization,value and thinking norms can be adopted.
