Construction of A Mechanism Blocking Information between Investigation and Court Trial and Reinterpretation of the Three Principles:Exploration on the Substantiation of Criminal Trial
In the Report to the 20th National Congress of the Communist Party of China,Xi Jinping,general secretary of the CPC Central Committee pointed out the significance to ensure strict and impartial administration of justice through deepening comprehensive and integrated reform of the judicial system,fully and faithfully enforcing judicial accountability,and accelerating the development of a fair,efficient,and authoritative socialist judicial system.The substantiation of court trials is not only a key to consolidating the"trial-centered"reform,but also an important embodiment of a country's judicial civilization.The reason for the obstruction caused by case file dependence in China's current substantive reform of court trials is the misunderstanding of the three principles of"dividing responsibilities,coordinating efforts and checking each other",thus resulting in the rigid"assembly line"of litigation structure and the phenomenon of case file dependence in court trials.Therefore,it is imperative to properly understand the significance of substantive court trials,target existing obstacles and seek for countermeasures.These efforts will be profoundly significant for adhering to the path of socialist rule of law with Chinese characteristics,advancing the development of socialist rule of law with Chinese characteristics,and establishing China as a socialist country under the rule of law.
