开放型经济新体制背景下的犯罪新风险及其治理路径

摘要
进入新时代,开放型经济新体制加快构建,其在激发高质量发展活力的同时,亦带来不少犯罪新风险.开放型经济新体制背景下的犯罪呈现出新特点、新趋势,集中表现为"四个结合",即体制的创新性与犯罪的多样性、经济的开放性与犯罪的扩张性、金融的虚拟性与犯罪的隐蔽性、网络的无界性与犯罪的跨域性相结合.对此可从合作治理、预防治理、专业治理、精准治理等方面着力,构建开放型经济新体制背景下犯罪风险治理的新路径.
Abstract
Having entered the"new era",China is striving to accelerate the establishment of new systems for higher-level open economy.This initiative has not only stimulated the vitality of high-quality development,but also brought considerable new crime risks.Crimes under new systems for higher-level open economy present new characteristics and trends,mainly embodied in the"four combinations",namely the combination of the innovation of systems and the diversity of crimes,the openness of the economy and the expansive nature of crimes,the virtual nature of finance and the concealment of crimes,the unbounded nature of the networks and the trans-regional nature of crimes.Considering these new characteristics and trends,we should put efforts into cooperative governance,preventive governance,professional governance and precise governance,thereby coming up with new prevention strategies for crime risks under new systems for higher-level economy.
