摘要
人类长期以来对动物权利的忽视不仅造成了严重的生态破坏,也给人类自身的生存与发展带来威胁.近年来层出不穷的与虐待动物相关的社会热点事件引发人们对于动物地位以及动物与人类关系的重新思考.当代人类的发展观应从"人类中心主义"转向"生态整体论".鉴于现行法中有关动物保护规定的严重缺疏,本文设想在私法层面赋予动物一种准法律主体的权利,具言之,未来可尝试在相关法律中构建一个大一统的"动物权"体系,但对此需要正确理解,赋予动物权利并不等同于赋予动物与人相同的权利.总之,要树立这样一种理念:保护动物,就是善待人类自己.
Abstract
Humans'long-term neglect of animal rights has not only caused serious ecological damages,but also posed threats to the continued survival and development of humans themselves.In recent years,the endlessly emerging hot issues relevant to animal abuse have triggered people's rethinking of animals'status and the relationship between animals and humans.In contemporary times,humans should change their development view from"anthropocentrism"to"ecological holism".In view of the lack of provisions on animal protection in current legislation,this article envisages granting animals a quasi-legal subject right from perspective of private law.Specifically,in the future,a unified system regarding"animal rights"should be established in relevant laws,but a correct understanding is required as granting animals rights does not mean giving animals the same rights as humans.In short,it is imperative to develop such an idea:protecting animals means kindly treating humans themselves.
