Approaches for Public Security Authorities'Participation in Enterprise Compliance Promotion from Administrative-criminal Convergence Perspective
With the continuous advancement of enterprise compliance system,the significance of administrative compliance has received extensive attention from the academic circles.However,administrative authorities do not currently possess the legal obligation to collaborate with criminal authorities in compliance cases,so the inadequate convergence between administrative law enforcement and criminal justice(hereinafter referred to as"administrative-criminal convergence")has become one of the critical challenges to be addressed in the promotion of compliance system.It is evident that relying solely on unilateral efforts of procuratorial authorities is impracticable in exploring the approaches for compliance promotion.This article suggests that,from the perspective of"administrative-criminal convergence",public security authorities,with dual attributes,should moderately extend their involvement in the administrative compliance.Based on the aspects of public security authorities and enterprises,administrative authorities,society,and their own team building,the article aims to explore effective approaches for public security authorities'participation in enterprise compliance promotion,highlighting such appropriate participation in administrative compliance can advance criminal compliance and facilitate a two-way optimization of the"administrative-criminal convergence"mechanism.
