摘要
监狱作为国家的刑罚执行机关,是维护刑罚严肃性和权威性的最后一道屏障,也是维护和促进社会公平正义的最后一道防线.监狱民警作为改造罪犯的主要力量,在执法过程中面临的刑事责任风险时刻存在,一旦刑事责任风险失范就会伴随诸多问题.因此,如何有效防控监狱民警刑事责任风险,激发监狱民警创造性改造罪犯,实现"守法公民"的法治改造目标,值得对其进行深入研究.
Abstract
A prison,the state's institution for executing penalties on criminals,serves as the final line of defense in maintaining the gravity and authority of criminal penalties,as well as the ultimate safeguard for upholding and promoting social fairness and justice.Prison police officers,being the primary force for reforming criminals,are constantly confronted with criminal responsibility risks while performing law-enforcement duties.Should such criminal responsibility risks spiral out of control,they are likely to give rise to a multitude of issues.Therefore,how to effectively prevent and control the criminal responsibility risks facing prison police officers,stimulate their creativity in reforming criminals,and achieve the rule-of-law goal by transforming criminals into"law-abiding citizens"is a topic worthy of further research.
