摘要
稳步规范推进涉案企业合规改革,关乎新时代检察权高质量发展.涉案企业合规检察权运行呈现"检察主导+专业介入"的全新行权模式,在试点探索中还存在该用不用、不该用乱用、监督考察和司法审查流于形式等问题,亟待建构高质效目标导向的制约监督体系,有效解决"纸面合规""合规腐败"等社会质疑与担忧.在具体路径上,可从分层分阶、诉讼构造和数据赋能等三个维度,探索构建涉案企业合规检察权运行制约监督体系,推动高质效办好每一个合规案件,为建立中国特色现代企业合规司法制度夯实实践基础.
Abstract
Steadily standardizing and promoting the compliance reform of enterprises involved in the cases is crucial for the high-quality development of procuratorial power in the new era.The current operation of procuratorial power with respect to the compliance of involved enterprises presents a new model that combines"procuratorial leadership with professional intervention".At the stage of exploration,many issues arise,including the failure to activate compliance procedures when necessary,the inappropriate activation of compliance procedures when unnecessary,and making the supervision process and judicial review a mere formality.It is imperative to construct a high-quality and target-oriented restriction and supervision system to effectively address and alleviate social doubts and concerns over"paper compliance"and"compliance corruption".Specifically,the construction of the restriction and supervision system for the operation of procuratorial power with respect to compliance of involved enterprises should be explored from three aspects:layering and grading,litigation structure,and data empowerment.This approach aims to facilitate the high-quality and efficient resolution of each compliance case,thereby laying a solid practical foundation for the establishment of a modern enterprise compliance judicial system with Chinese characteristics.
