摘要
在 2023 年全国检察长工作会议上,最高人民检察院党组提出了检察工作现代化的时代命题.释法说理能力作为检察工作现代化的重要内容之一,是维护司法权威和公信力的法治需要,是化解矛盾维护社会稳定的现实需要,是法律专业术语的理解需求.当前刑事申诉案件释法说理还存在难度大责任重和畏难情绪;目标设定过于僵化,难以适配复杂的案情;释法说理方法简单僵化,难以发挥实效等问题.为此,应强化思想认识,提升办案能力;适应申诉案件需求,优化目标设定;面向不同类型,针对性采取相应方法以提升刑事申诉案件释法说理能力.
Abstract
At the 2023 National Chief Procurators'Work Conference,the leading Party members'group of the Supreme People's Procuratorate advocated for the modernization of procuratorial work in the new era.The capacity of interpretation of law and reasoning serves as a critical element of this modernization effort.Moreover,it is also a rule-of-law requirement for upholding the authority and credibility of the judicial system,a practical need for resolving contradictions and maintaining social stability,as well as a necessity for comprehending legal terms.Currently,the problems concerning the interpretation of law and reasoning for criminal appeal cases are evident:the complexity of tasks and heavy responsibilities generate a fear of difficulty among procurators,the rigid pre-established objectives impede their adaption to complex cases,and the simple and inflexible approaches in the interpretation of law and reasoning fall short in exerting an efficacious influence.To enhance their capacities in interpretation of law and reasoning,procurators must enhance their ideological understanding,refine their case-handling abilities,conform to the needs of criminal appeal cases,optimize pre-established objectives,and adopt appropriate methods according the types of criminal appeal cases.
