我国专家陪审制度的司法适用困境及完善

摘要
当前专家陪审制度程序运行保障建设存在不足,司法实践中专家陪审员行权受阻,陪审程序流于形式,法官"以鉴代审"等现象大量存在,这常常导致特定领域案件的裁判结果缺乏专业性.为此,应当从保障当事人的诉讼权利角度出发,以促进专家陪审员充分行使审判权利为目的,构建一套全面且完善的专家陪审制度规则.基于这一思路,司法机关应选取具有专门知识的专家陪审员组成技术陪审团,赋予其独立于合议庭的审判主体地位,并就陪审团适用范围、人员选任、问题清单制订以及纠纷解决机制等问题作出详细规定,增强判决的科学性与合理性.
Abstract
Currently,there are deficiencies in the construction of operational guarantee for procedures of China's expert juror system.In the judicial practice,expert jurors often encounter obstacles in exercising their rights,with jury procedure remaining a mere formality.Moreover,phenomena such as judges' practice of"trial by appraisal"have resulted in judgments' lacking professional credibility in specific fields.To address these issues,this study advocates for the establishment of a comprehensive and well-structured expert juror system that ensures the protection of litigants' rights while enabling expert jurors to fully exercise their judicial rights.Based on this idea,judicial authorities need to select expert jurors with specialized knowledge to technical juries,grant them the status of trial subject independent of the collegial panel,and make detailed provisions on the application scope of the expert jury,personnel selection,issue checklist formulation,and dispute resolution mechanisms,so as to enhance the scientificity and rationality of the judgment.
