The Judicial Application of Constitutionality Interpretation:Practice and Reflection
The judicial application of constitutionality interpretation plays an important role in promoting the implementation of the constitution and protecting the rights and interests of the parties.At present,the basic pattern of judicial application of constitutionality interpretation is the differences in understanding the concept of constitutionality interpretation,the extensive use of forms,and the single type of litigation used to adjudicate cases.From the perspective of system and theory,we can find that the mechanism of judicial application of constitutionality interpretation needs to be improved,the guidance of trial practice is absent,and the supply of theory is insufficient.The main ways to perfect the judicial application of constitutionality interpretation are to construct the supervision mechanism during and after litigation,strengthen the guidance of trial practice and shift the focus of theoretical research.
