What is the relationship between social law and civil law?Is social law a special law of civil law or an independent legal discipline?Is it a specific legal department or a third jurisdiction?These basic theoretical questions have been greatly debated in the academic community.As early as 1934,Mr.Fumio Hashimoto,the founder of Japanese social law,deeply explained these theoretical issues in his masterpiece Social Law and Civil Law.The author explored the trajectory of the development of social law from Roman law to modern civil law,and systematically discussed the dialectical relationship between social law and civil law,emphasizing the progressive significance of labor protection law and the independent legal status of social law.The concept and system of social law is constructed and jurisprudentially developed with the"social person"as the main body.It is also the most profound commemoration of the 90th anniversary of the publication of this work and the 90th anniversary of Mr.Hashimoto's death.
