The Time Effect of the Legal Interpretation of National People's Congress Standing Committee
According to the different interpretation situations,the legal interpretation of the Standing Committee of the National People's Congress can be divided into three types:interpretation type,creation type and comprehensive type.Different types of legislative interpretation correspond to different time effect rules.The effective time of legislative interpretation depends on the situation of its interpretation.The interpretative legal interpretation should take effect from the date of the effective of the law,the creative legal interpretation should take effect from the date of the promulgation of the interpretation or the date of the regulation,and the effective time of the comprehensive legal interpretation should be classified and discussed.The expiration time of legislative interpretation depends on the change of the effect of the object of interpretation.The retroactivity of legislative interpretation should follow the principle of"law is not retroactive",but there are exceptions to retroactivity in interpretative legal interpretation.The effective time,ineffective time and retroactivity of legislative interpretation affect each other and are interlinked,which together constitute the time validity rules of the Standing Committee of the National People's Congress.
